Can I build a granny flat without consent in NZ 2026?

Short answer

From 15 January 2026, MBIE's new exemption allows a single-storey, detached, self-contained dwelling up to 70 m² to be built without a building consent in many cases — provided the design and construction is by or supervised by a Licensed Building Practitioner and meets the Building Code. It still has to comply with the District Plan, so a resource consent or council notification may still be required. It's not a free pass — it's a paperwork shortcut.

What 'no consent' actually means

The exemption removes the Building Consent step from the council — saving consent fees and weeks of waiting. The LBP design + LBP supervision replaces that check.

It does not remove the Resource Consent / District Plan step. Most councils still require notification, and some sections (heritage overlays, coastal hazards) won't be eligible at all.

What the LBP requirement means in practice

Only an LBP can design or supervise the work. That's a real constraint — there are about 25,000 LBPs in NZ but very few sign on as 'supervisor' for an owner-led build. Expect to pay a supervision fee similar to a small consent.

If something goes wrong, the LBP carries the professional responsibility, not the council. That changes who you sue if things fail.

Sale and resale implications

A consent-free dwelling under the exemption still shows up on a LIM — councils will record the LBP-supervised exemption. Banks and insurers are still working out how they treat these, so check with both before you commit.

If you sell within a year or two, expect questions on the paperwork. Keep the LBP design records, supervisor sign-off, and any council acknowledgement.
